Unfreezing of EuroClear Assets

We can help obtain permission to unfreeze assets (Demande de dérogation de dégel des fonds et de ressources économiques) that have been frozen due to sanctions against the DPR.

Our company is located in Belgium, and we are in regular direct contact with EuroClear staff. Document submission and interaction are carried out in French.

CONDITIONS FOR OBTAINING A LICENSE

  • Confirmation of the purchase of each security
  • Power of attorney
  • Confirmation that you are not on the sanctions list
  • Letter from a guarantor
  • Confirmation from a broker in Europe about opening an account (depository) where assets will be transferred after unlocking
  • Proof of cessation of relations with the DPR.
  • Preferably having a second citizenship

Additional Information

  • The license is personal, so the request should have been submitted before January 7, 2023, on behalf of the client, not the broker. We see no obstacles to submitting the application after this date, as well as in case of refusal.
  • If your broker submitted a license request before 07/01/2023, the right strategy is to separate your case into a separate process and provide all the necessary papers. Requests submitted in bulk (for example, by a broker) are considered last.
  • We submit a request to separate your case with the provision of a guarantor, whose function is to provide reporting confirming the fact of asset realization. The guarantor can be a European legal entity, an accountant, or a lawyer. The guarantor bears responsibility up to criminal liability. We provide a guarantor service.
  • We provide additional documents in the official language of Belgium (we work in French), as all documents must be provided in accordance with accepted norms, including to protect oneself from refusal purely on formal grounds (for example, using a non-official language in correspondence).
  • It is difficult to predict at this moment how long it will take to obtain the license, but in any case, it is important to protect oneself from the risk of refusal on formal grounds and do everything to ensure that the assets are not confiscated in accordance with possible new political decisions, based on the degree of escalation of the situation.
